Debt recovery

Debt collection in Morocco: a practical guide for creditors

Unpaid invoices, overdue loans or unpaid rent: collecting a debt in Morocco follows a sequence of steps, each with its own rules and time limits. This guide summarises the path from a first reminder to enforcement, including what foreign creditors should prepare.

1. The path in brief

  1. Amicable reminders and negotiation.
  2. Formal notice (mise en demeure).
  3. Court proceedings: injunction to pay where available, or an ordinary claim.
  4. Interim measures where there is a risk of insolvency.
  5. Enforcement of the judgment through the competent public officers.

2. Step one: gather evidence and try an amicable solution

Start by assembling the contract or purchase order, invoices, signed delivery notes, statements, and correspondence. A clear written record of the amount due and of the debtor’s acknowledgement, if any, is decisive. An amicable reminder or a proposed payment schedule may resolve the matter quickly, but avoid any written acknowledgement or schedule that could affect limitation periods without advice.

3. Formal notice

A formal notice sets a precise date for the demand and puts the debtor on notice. It should state the amount, its basis and a reasonable deadline. It is usually prepared or reviewed by a lawyer to prepare the ground for proceedings.

4. Going to court

Where the conditions are met, an injunction to pay can be a faster route for a clearly established money claim. Otherwise, an ordinary claim is filed before the competent court; commercial disputes are generally heard by the commercial courts. Proceedings are conducted in Arabic, and documents in other languages usually need to be translated.

5. Interim measures and enforcement

If the debtor may dispose of assets, a conservatory attachment may be requested. Once a judgment is final or enforceable, enforcement is carried out through bailiffs (court officers) by attaching bank accounts, receivables or other assets, depending on what can be identified.

6. Limitation periods

Do not wait. As a general rule, obligations arising from commercial dealings are subject to a five-year limitation period, save specific provisions to the contrary, and other periods may apply. Guarantees and acts such as acknowledgement of the debt or court action can affect the calculation. See our article on the limitation of unpaid loans (in French): Prescription d’un crédit impayé.

7. Points for foreign creditors

  • Retain local counsel: representation before Moroccan courts is reserved in principle to lawyers.
  • Prepare translated copies of key documents and evidence of the debtor’s identity and address.
  • A foreign judgment generally cannot be enforced in Morocco without prior recognition by a Moroccan court (exequatur).
  • Check the governing law and jurisdiction clauses in your contract before starting proceedings.

8. Collection agency or lawyer?

A collection agency may help with amicable reminders, but it cannot in principle represent you in court or carry out enforcement measures. For contested, large or old claims, involve a lawyer early. Frequently asked questions

How long does debt collection take in Morocco?

There is no standard duration: it depends on whether the debt is contested, the court concerned, and the enforcement steps required.

Can I collect a debt from Morocco without travelling?

Usually yes, through a local lawyer holding a proper power of attorney, subject to the formalities required for documents signed abroad.

Is a formal notice mandatory?

It is strongly recommended: it fixes the date of the demand and supports later proceedings. Some situations have specific requirements.

Can a foreign court judgment be enforced in Morocco?

Generally only after recognition by a Moroccan court (exequatur), which involves specific conditions.
