FAQ

Frequently asked legal questions

Unpaid loans, procedure, deadlines, security interests, fees: general answers to the questions most often put to the firm.

The firm and appointments

How does a first appointment work?
The first appointment is used to present your situation, review the initial documents and identify possible courses of action. It does not amount to final acceptance of the case.
Does the firm handle cases in Arabic and French?
Yes. The firm works in French and Arabic, for consultations as well as for legal documents, correspondence and proceedings.
Which areas of law does the firm cover?
The firm acts in banking law and debt recovery, real estate and security interests (mortgages, enforcement), commercial and company law, civil law and criminal law, both as adviser and before the courts of the Kingdom.
Where is the firm located and how do I book an appointment?
The firm is located at 20 Rue Dakhla, Apartment 2, Ville Nouvelle, Meknes. Consultations are by appointment, Monday to Saturday, 9:00 to 17:00. You can call 05 35 40 16 16 or 06 61 89 36 67, or write from the Contact page.
Does the website form create a lawyer-client relationship?
No. Sending a message does not amount to legal advice or acceptance of a case. An express confirmation from the firm is required.
Is my information confidential?
Exchanges with the firm are treated confidentially, in accordance with professional secrecy and applicable regulations.
Can the firm assist me against a bank?
Since the firm acts for banking institutions, it may not be able to assist you if it already represents the institution concerned. Your situation is reviewed at first contact so that you can be referred to another lawyer if necessary.

Unpaid loans and debt recovery

What are the risks of an unpaid loan?
The bank may send reminders and then a formal notice, bring the matter before the court to obtain a payment judgment, and enforce that judgment by seizing accounts or assets and, where the loan is secured by a mortgage, by a judicial sale of the mortgaged property.
What should I do if I receive a formal notice from my bank?
Do not leave it unanswered: reply in writing, keep the acknowledgement of receipt, ask for a detailed statement of the debt and, where possible, propose a realistic repayment plan. Seeing a lawyer at this stage is advisable.
Can I negotiate with the bank?
Yes. A payment holiday, rescheduling, restructuring of the debt or instalment payments remain possible at almost every stage, and any agreement should be put in writing.
Can I challenge the amount claimed by the bank?
Yes. The debtor may request a detailed statement and challenge before the court the calculation of interest, penalties or costs, or even the existence of certain sums. The judge examines the documents produced by both sides.
What should I do if I receive a summons from the court?
Do not ignore it: if you do not appear, the court may rule in your absence. Note the hearing date, gather your documents (contract, repayment schedule, statements, payments made) and consult a lawyer quickly.

Procedure, deadlines and enforcement

How long does a debt recovery procedure take?
There is no single duration. An uncontested case may be resolved in a few months; a case involving an appeal, procedural incidents or a property that is hard to sell may last several years.
What are the deadlines to appeal a decision?
Appeal deadlines run from the notification of the decision and cannot be made up once missed. Any decision you receive should be reviewed by a lawyer without delay.
Which court has jurisdiction: the commercial court or the court of first instance?
As a general rule, the commercial court hears cases where the loan is professional or commercial in nature, and the court of first instance hears the others. Jurisdiction is checked case by case.
What does the new Code of Civil Procedure change?
Law no. 58.25, in force since 24 August 2026, replaces the 1974 code and modernises in particular the notification of documents and the control of deadlines.
Can a mortgaged property be sold by force?
Yes. Where the loan is secured by a mortgage and remains unpaid, the bank may start enforcement of the security, which leads to a public auction of the property. The proceeds are first applied to the mortgage creditor.
Does the sale of the mortgaged property clear the whole debt?
Not necessarily. If the auction price, after costs and priority creditors, does not cover the whole claim, a balance may remain due and be subject to other enforcement measures.
Does a FOGARIM guarantee wipe out the borrower’s debt?
No, not automatically. The guarantee first protects the bank in case of default and governs relations between the bank and the guarantor body, without in principle releasing the borrower from the obligation to repay.
What does a guarantor risk?
Within the limits of the commitment given, the bank may turn to the guarantor if the main debtor does not pay. Guarantors also have rights and defences, and should be informed from the outset.
Does a lawyers’ strike suspend deadlines?
In principle, no: legal deadlines continue to run from notification, unless a specific exception applies. Always have deadlines checked by a lawyer.

Fees

How are fees determined?
Fees are set according to the nature of the case, its complexity, the work required and, where applicable, the agreement in force. The method is described on the Fees page.
What is the difference between fees and court costs?
Fees remunerate the lawyer’s work. Court costs and disbursements (bailiff, expert, duties, travel) are sums advanced for the proceedings. Foreseeable costs are specified before any work begins.
Is a written fee agreement drawn up?
Yes. Remuneration terms are set in writing before any work begins, together with the assignment, foreseeable costs and the conditions for ending the assignment.
